Feature Films

In order to accommodate faculty who wish to show feature-length films in the classroom, the Cambrian College Library has licences with two companies that hold rights to feature films which allow for showing these films in educational institutions:

Search for the film title you wish to show in the classroom. If it is found on one of these web sites, you may show the film to your class without copyright restriction.

Access Copyright at Cambrian College

Canada’s Copyright Act prohibits the unauthorized reproduction of copyright-protected works. Copyright is automatic, does not need to be registered and is enforced internationally. Both the copying of works and distribution or sale of illegal copies are infringements of copyright under the Act. Cambrian College holds a comprehensive licence agreement with Access Copyright for the use of print materials. Access Copyright represents a group of copyright holders for whom it administers copyright and collects predetermined fees for the use of those rights. The agreement specifies how much material may be copied, in what circumstances, and when royalties must be paid. In the case of photocopying, permission to reproduce copyright-protected works must be obtained from the copyright owner or Access Copyright.

Fair Dealing

Canada’s Copyright Act allows for a limited amount of copying under a provision known as fair dealing, defined as copies made for “private study, criticism or review.” This does not allow for the making of multiple copies nor for the use of copies in public places like classrooms and libraries (Copyright Act, R.S.C. 1985, c. C-42, s.29).

What You Can Copy

When copying from printed library reserves, making handouts for class, or using self-serve photocopiers on campus, you can copy:

• Up to 10% of a published work or up to one of the following:
• One chapter that is up to 20% of a published work;
• An entire single short story, play, poem or essay from a collection of such works;
• An entire single item of print music from a collection of other works;
• An entire article from a reference book such as an encyclopedia;
• An entire reproduction of an artistic work from a book containing other works.

Course Packages

Under Cambrian College's licence with Access Copyright, faculty may photocopy up to 15% of a published work* to include in course packages which are compiled and sold to students. Royalties are subsequently paid to Access Copyright on a per page, per copy basis and are distributed to the creators and/or publishers who hold copyright for the material.

*Note that further limits may apply; for example, only 5% of a textbook may be copied for inclusion in course packages. Please refer to the Access Copyright web site or the College's licence agreement.

 
 

Transparencies

The Access Copyright licence allows for transparencies to be made from published works for class presentations. Under the licence, you may not copy from transparency to transparency or from transparency to paper.

Digital or Electronic Copying

Cambrian’s licence agreement is limited to copying that results in a hard or paper copy and therefore does not allow for digital copying such as conversion of print materials to CD-ROMs or secure Internet sites. Permission to copy materials in digital format must be obtained from the copyright holder or from Access Copyright on a transactional basis.

DVDs and Videotapes

It is illegal to record broadcast television programs onto a videotape or DVD and to show that program in a classroom setting. DVDs and videotapes labeled with “For home use” or the equivalent are restricted for personal use in the privacy of your own home and are not to be shown in a classroom setting. Included in this category are videos or DVDs rented from a video store and most videos or DVDs purchased in a department store or advertised in the general press or on television.

Search for the film title you wish to show in the classroom at Audio Cine Films Inc. or at Criterion Pictures. If the title is there and you decide to show the film, please send the Library an email with the date, time and title for our records.

What You Can’t Copy

Systematic cumulative copying is prohibited, meaning that you cannot copy 10% of a publication one day, 10% the next, and so on. You may not copy any works excluded from the agreement with Access Copyright, specifically:

• Print music
• Workbooks and instruction manuals
• Newsletters
• Letters to the editor
• Advertisements
• Works published by the Government of Canada or any province or territory (excluding the Province of Quebec)
• Unpublished and non print copyright materials such as originals of artistic works
• Publications from specific rightsholders as outlined in the Post-Secondary Exclusions List (PDF)
