Access Copyright at Cambrian College
Canada’s Copyright Act prohibits the unauthorized reproduction of copyright-protected works. Copyright is automatic, does not need to be registered and is enforced internationally. Both the copying of works and distribution or sale of illegal copies are infringements of copyright under the Act. Cambrian College holds a comprehensive licence agreement with Access Copyright for the use of print materials. Access Copyright represents a group of copyright holders for whom it administers copyright and collects predetermined fees for the use of those rights. The agreement specifies how much material may be copied, in what circumstances, and when royalties must be paid. In the case of photocopying, permission to reproduce copyright-protected works must be obtained from the copyright owner or Access Copyright.
Fair Dealing
Canada’s Copyright Act allows for a limited amount of copying under a provision known as fair dealing, defined as copies made for “private study, criticism or review.” This does not allow for the making of multiple copies nor for the use of copies in public places like classrooms and libraries (Copyright Act, R.S.C. 1985, c. C-42, s.29).
What You Can Copy
When copying from printed library reserves, making handouts for class, or using self-serve photocopiers on campus, you can copy:
• Up to 10% of a published work or up to one of the following:
• One chapter that is up to 20% of a published work;
• An entire single short story, play, poem or essay from a collection of such works;
• An entire single item of print music from a collection of other works;
• An entire article from a reference book such as an encyclopedia;
• An entire reproduction of an artistic work from a book containing other works.
Course Packages
Under Cambrian College's licence with Access Copyright, faculty may photocopy up to 15% of a published work* to include in course packages which are compiled and sold to students. Royalties are subsequently paid to Access Copyright on a per page, per copy basis and are distributed to the creators and/or publishers who hold copyright for the material.
*Note that further limits may apply; for example, only 5% of a textbook may be copied for inclusion in course packages. Please refer to the Access Copyright web site or the College's licence agreement.
